BigONE User Agreement

The BigONE User Agreement (hereinafter referred to as the "Agreement") is the specification of the rights and obligations between BigONE Investment Corporation (Party B, hereinafter referred to as "BigONE") and BigONE users (Party A).

Please read this agreement carefully. For any violation of this agreement, BigONE reserves the right to terminate the provision of services to relevant users. For any suspicious user suspected of violating national laws and regulations, BigONE has the right to report suspicious transactions to relevant departments, freeze user assets when necessary, and transfer them to relevant departments for processing. 

The ownership and operation rights of all services provided by BigONE (https://big.one) belong to the BigONE team. BigONE can modify the terms of this agreement. Once the modified agreement is released, it will effectively replace the original agreement. Users can check the latest agreement at any time.

I. Agreement content and release

1.1. The content of this agreement includes the body of the agreement and all the category rules that BigONE has published or may publish in the future. All rules are an integral part of this agreement and have the same legal effect as the body of the agreement. Except for a clear statement, any services provided by BigONE essentially affiliated companies (hereinafter referred to as BigONE services) are bound by this agreement.

1.2, You should carefully read all the contents of the agreement before using the BigONE service. If you have any questions about this agreement, you should consult with BigONE. Despite whether you‘ve actually read the contents of this Agreement before using the BigONE service, as long as you use the BigONE service, this agreement is bound to you, you don't have the right to claim the proposal is invalid, or requires the revocation of this agreement for not have read the contents of this agreement.

1.3 You are committed to accept and comply with this Agreement. If you do not agree to this agreement, you should immediately stop the registration/activation program or stop using the BigONE service. If you continue to use the BigONE service, you are accepting all the terms of this Agreement.

1.4, BigONE has the right to develop, modify this agreement or various rules, and will give notice through a public announcement without informing you alone. Once the changed agreement and rules have been published on the website, they will take effect immediately. If you do not agree to the change, you should immediately stop using the BigONE service. If you continue to use the BigONE service, you accept and are willing to comply with the amended agreements and rules.

II. Registration and account

2.1, registration eligibility

You must verify that you are not a US Citizen or Resident, as BigONE is currently not available in the United States. 

You should be a natural person, legal person, or other organization with full civil rights and full civil capacity when you complete the registration process or use the BigONE service in other ways that BigONE allows. If you do not have the above qualifications, you and your guardian shall bear all the consequences arising therefrom, and BigONE shall have the right to cancel or permanently freeze your account and claim against you and your guardian.

At the same time, you need to ensure that you are not listed in any terrorist personnel list, such as the list of terrorist organizations and terrorist groups issued by United Nations Security Council resolutions, nor by the user's administrative law enforcement agencies to restrict or prohibit the application of any trading platform.

2.2, the purpose of registration

You promise that your registration with BigONE is not intended for the purpose of criminal activity or the destruction of the BigONE digital asset transaction order.

2.3, the registration process

You agree to provide valid contact information in accordance with the requirements of the BigONE registration page, including but not limited to a mobile phone number, ID number, and other information; set the BigONE account number and password, and ensure the authenticity, completeness, and accuracy of all information provided. You may not be liable for any direct or indirect damages and adverse consequences arising from your inaccurate, inaccurate, or incomplete information at the time of registration. After you sign up, your registered account will not be canceled or deleted.

2.5, account security

You are responsible for the custody and confidentiality of your BigONE account and password, and you are responsible for all activities (including but not limited to information disclosure, posting, online click consent, or submission of various rules and agreements that occur under that login and password, Online renewal of the agreement or purchase services, etc.) take responsibility.

You agree:

(1) You will immediately notify BigONE if any person has unauthorized use of your BigONE account and password or any other breach of confidentiality,

(3) Make sure you leave the site/service in the correct way at the end of each logon period. III. BigONE service

3.1, service content

3.2, service costs

Your expenses, as well as all hardware, software, services, and other expenses incurred in your use of the BigONE service, are borne by you independently.

When you use the BigONE service, BigONE has the right to charge you a fee for the appropriate rules. BigONE has the right to make and adjust service charges, depending on the billing method listed on BigONE when you use the BigONE service or other written agreement between you and BigONE. Unless otherwise stated or agreed, you agree that BigONE has the right to deduct the service charge directly from your account assets.

3.3, service rules and the use of norms

You understand and agree that BigONE has the right to provide you with necessary information such as user information and transaction records provided to BigONE at the request of government departments (including the judiciary and administration). If you are suspected of infringing upon the legitimate rights and interests of others, such as intellectual property rights, BigONE also has the right to determine the alleged infringement in the case of the existence of the right to provide you with the necessary identity information.

3.3.2, in the course of dealing with other users, abide by the principle of good faith, do not take the unfair competition, do not disturb the normal order of online transactions, do not engage in acts related to online transactions. If you are dealing with other users during the transaction on BigONE, once you or any other member of the party or both parties jointly submit BigONE to request mediation, BigONE has the right to make a mediation decision based on unilateral judgment, and you understand and agree to accept BigONE's Judgment and mediation decision.

3.3.3, you are committed to making no commercial use of any of the data on BigONE, including but not limited to the use of information displayed on the BigONE station in any manner without the prior written consent of BigONE. Do not use any device, software, or routine to intervene or attempt to interfere with the normal operation of BigONE or any transactions and activities that are taking place on BigONE. You may not take any action that would result in an unreasonable large data load imposed on BigONE network equipment.

3.3.4, you understand and agree that BigONE has the right to make a unilateral determination of whether or not you violate the above commitments and to process or terminate your service in accordance with the applicable rules of the unilateral determination of the results without the need for your consent or advance notice you. Based on the need to maintain BigONE transaction order and transaction security, BigONE has the right to perform the operation of closing the corresponding transaction order in the event of malicious order or disruption of the normal order of the market. 3.3.5. For acts that you implement on BigONE, including those that you have not implemented on BigONE but have affected BigONE and its users, BigONE has the right to unilaterally determine the nature of your conduct and whether it constitutes a breach of this Agreement and Accordingly make the appropriate punishment. You should keep all the evidence in your possession and deal with the adverse consequences of the inability to provide sufficient evidence. You shall, in your sole and exclusive sense, assume all liability for damage to any third party in respect of any alleged breach of the Agreement and shall ensure that BigONE is free from any loss or expense. If you are suspected of violating the laws or the provisions of this Agreement, make any loss to BigONE, or be subject to any third party claims, or subject to any administrative penalties, you shall indemnify the BigONE of any loss and expenses incurred, including reasonable The cost of the lawyer.

3.4, service changes, interrupt, termination restrictions, freeze and thaw

3.4.1 Change of Service: BigONE reserves the right to make changes to the contents of this Agreement or other terms of service and operation rules issued by BigONE at any time. 3.4.2, interruption or termination of service:

Upon termination of this Agreement, you are not entitled to require BigONE to continue to provide you with any services or to perform any other obligations, including but not limited to requiring BigONE to retain or disclose any information in its original account to you or any third party Information you have not read or sent. In the event of any of the following circumstances, BigONE reserves the right to discontinue or terminate the services provided to you without notice:

(2) you violate the relevant laws and regulations of the country or the agreement of this agreement;

(3) the requirements of the competent authorities or the political and legal departments;

(4) for security reasons or other necessary circumstances.

After the BigONE interruption or termination of your offer of the BigONE service, you shall deal independently and fully incur any costs, disputes or losses arising from any of the following transactions arising out of the transactions of the Company prior to the suspension or termination of the Service in accordance with the following principles, And shall ensure that BigONE is free of any costs or costs incurred:

3.4.3, service freeze and unfreeze:

You should fully understand that the unfreezing application is not necessarily allowed and the user should cooperate with BigONE when applying for unfreezing verification of your identity and other relevant information, including but not limited to identity information, identity cards, passports, other valid identification documents and other information or documents required by BigONE.

IV. Trading Rules

You are committed to the BigONE transaction, through the BigONE and other users of the process of digital assets in the process of good compliance with the following BigONE digital asset trading rules:

4.1, browsing transaction information: When you browse the digital asset transaction information in BigONE, you should carefully read all the contents contained in the transaction information, including but not limited to the digital asset price, commission, handling fee, buy or sell direction, when you Completely accept all the contents of the transaction information before trading.

4.2, recharge: You understand and agree that BigONE will be updated from time to time to provide rechargeable currency or currency, currently only support the digital assets recharge.

4.3 You have the right to withdraw the balance in the BigONE account at any time, but you should abide by BigONE's currency withdrawal rules and pay the corresponding withdrawal fee to BigONE.

4.4, submitted to the commission: You can check the transaction information to confirm the transaction can be submitted after the commission. Once you have submitted your transaction commission, you are authorized to resell, and BigONE will automatically complete the matching transaction without having to notify you in advance of the transaction that satisfies your entrusted price.

V. User Rights and Licenses

BigONE is responsible for providing you with "status" and "available" status. BigONE makes no warranties, either express or implied, with respect to the Services, including, but not limited to, the suitability of BigONE Services, without errors or omissions, persistence, accuracy, reliability, and fitness for a particular purpose.

5.1, you have the right to obtain the blockchain asset information from BigONE to find the object of the transaction. BigONE acts only as your trading platform and can not control the legality of the blockchain assets involved in the trading platform, the authenticity or accuracy of the transaction information, and the ability of the parties to fulfill their obligations in the transaction agreement. You should be determined by yourself to determine the authenticity, legality and validity of the relevant blockchain assets and information, and bear your own responsibilities and losses.

5.2, when you register successfully, you have the right to trade and withdraw the transaction in BigONE on the blockchain. But need to pay attention to that BigONE only supports blockchain assets.

5.3, you use the BigONE service in the process, if you encounter BigONE tools or features difficult to use, there is doubt on the BigONE rules, recharge or mention when the charge/error address or a long time not credited and other issues, have to BigONE Submit a work order to apply for inquiry or to seek help. 5.4, you have the right to make comments and suggestions on BigONE services, and BigONE will decide whether or not to adopt it at your discretion. VI. LIMITATION OF LIABILITY AND DISCLAIMER

You acknowledge and agree that BigONE is not liable for any damages caused by any of the following circumstances, whether or not such loss or damage can be reasonably foreseen by BigONE and whether or not BigONE has previously been advised of the possibility of such loss or damage:

6.1, specific users and specific transactions may be a major violation or breach of contract.

6.3, your misunderstanding of BigONE service.

VII. Effectiveness, interpretation, alteration, and termination of the agreement

This agreement takes effect immediately on the date of publication, and when you click on the agreement button when registered, it is legally binding for you and BigONE when you use the service of BigONE.

You agree that BigONE shall have the right to terminate or provide you with some or all of the BigONE services, temporarily freeze or permanently freeze (delete) your account's rights in BigONE for any reason without prior notice, and BigONE doesn't need to assume any obligations to you or any third party for this purpose. BigONE has the right to continue to keep the information, records and other information relating to the account, and the use of the information. (1) after the termination of your service to BigONE, you are suspected to be registered as a BigONE user directly or indirectly or in the name of another person;

Your account service is terminated or your account has been permanently frozen (canceled) after BigONE's permission has been made. You are not obliged to keep or disclose any information in your account and have no obligation to forward to you or a third party any information you have not read Or sent the information.

You agree that after you terminate your contract with BigONE, BigONE will still have the following rights: Continue to save your user information and all transaction information during your use of the BigONE service. You are in violation of this Agreement during the use of the BigONE service, and BigONE may claim your rights under this Agreement.

VIII. Application of law, jurisdiction and other

8.1, This agreement contains the general specifications that you would need to comply with, and that you are required to comply with the specific specifications applicable to the platform when you use a BigONE (see your other agreements and platform rules that you have signed with the platform content). If the general specification is inconsistent or conflicting with the specificity of the specification, the particularity of the specification has priority.

8.2 The dispute arising from this agreement shall be based on the platform to which you are using the service to determine the specific objection, for example, the dispute arising from your use of the BigONE service shall be communicated and handled by the operator of BigONE. Once the dispute arises, you and BigONE's operators agree to defend the people's court for the first instance of the court.

IX. Agreement

Party A: BigONE registered users          Party B: BigONE

Party A (including individual and institutional users) undertake the following:

Party A has the legal status of the corresponding investment, there are no legal or administrative regulations that prohibit or restrict the situation.

All documents provided by Party A are true, comprehensive, valid and lawful, and the legal sources of funds are guaranteed.

Party A undertakes to consciously abide by the laws, regulations, rules and regulations and regulatory documents relating to Party B.

Party A undertakes to have a good understanding of the trading rules, trading practices, trading knowledge, and products invested before investing and is fully aware of the risk of loss and profitability that may be implied in the investment process.

Party A has committed to fully understand the meaning of "trading self-financing", knowing all investment carried out by Party A is likely to be profitable, and there is also the possibility of loss,  and to be responsible for the result regardless of the result of the investment is profit or loss.

Party A and Party B agree that the parties shall agree to use and acknowledge the electronic signature when Party A use the service  provided by Party B from the date of signing this Agreement:

Party A confirms that it agrees to accept the relevant electronic contract or instrument in the process of establishing the transaction system, service system and other business systems on the computer, electronic terminal and network, and then sign the corresponding contract with Party B. The signature or seal of the paper contract shall have the same legal effect and shall not require the signature of a paper contract or instrument.

Party A shall properly keep the relevant passwords for logging in to Party B’s network platform, transaction system, service system and other business systems. All operations after Party A’s password authentication and login to Party A’s account shall be deemed as Party A’s own actions, and Party A shall bear the responsibility for all legal consequences arising therefrom.
